Endocrine Disruptors Regulation: Update in France

On October 12th, France published three ministerial decrees setting out the obligation to inform consumers about the presence of known, suspected, or alleged endocrine disruptors in products.

The “Loi nº 2020-105“, also known as the ‘AGEC law,’ was enacted on 10 February 2020. The law mandates that manufacturers of consumer products containing proven, presumed, or suspected endocrine disruptors must provide the necessary information for the public to electronically identify these substances in the products. This obligation aligns with the objectives of the SNPE2 (Second National Strategy on Endocrine Disruptors).

These three decrees complete the regulatory implementation of this obligation, which the Décret nº 2021-1110 established. These new decrees set out respectively:

This information must be accessible to the public for foodstuffs, substances, mixtures, and articles, excluding medicines. The deadline for compliance is 12 April 2024 and it will be mandatory if the concentration exceeds 0.1% by mass. This concentration can be either in the product itself or in its primary packaging.

The “Ministère de la Transition écologique” has published a FAQ on its website explaining how this regulatory obligation fits with the AGEC law (article 13-I).
